Welcome to 3PCB! These Terms of Service (the "Terms") are a legal agreement between you ("User", "you") and 3PCB (hereinafter referred to as "we", "us" or "our") governing your access to and use of our website at https://www.3pcb.com (the "Site") and our services, including but not limited to PCB production, SMT assembly, 3D/CNC machining, and PCB design (collectively, the "Services"). By accessing or using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any other policies referenced herein. If you do not agree to these Terms, please do not access or use the Site or Services.

1. Acceptance of Terms

By clicking "sign up", "place order" or otherwise accessing or using the Site or Services, you confirm your acceptance of these Terms. We reserve the right to modify, update, or revise these Terms at any time in our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Site or Services after such changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms regularly to stay informed of any updates.

2. Eligibility

Our Site and Services are intended for use by adults. If you are under the age of 18 (or the age of majority in your jurisdiction), you must obtain the consent of a parent or legal guardian before using the Services, and such parent or legal guardian must agree to these Terms on your behalf. By using the Services, you represent and warrant that: (a) you have the legal capacity to enter into a binding agreement; (b) you are authorized to use the Services under the laws of your jurisdiction; and (c) you will comply with these Terms and all applicable local, national, and international laws and regulations.

3. Your Account

3.1 Account Creation

To access certain features of the Services, you may need to create an account. You agree to provide accurate, complete, and up-to-date information during registration and to maintain the accuracy of such information. You are solely responsible for maintaining the confidentiality of your account credentials (including your password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

3.2 Account Termination

We may suspend, disable, or terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or illegal activity, or for any other reason in our sole discretion. You may terminate your account at any time by contacting us at service@3pcb.com. Upon account termination, you will no longer have access to the Services, and we may delete your account data (subject to applicable legal requirements).

4. Acceptable Use Policy

4.1 Prohibited Content and Activities

You represent and warrant that you will not use the Site or Services for any illegal, unauthorized, or prohibited purpose. You agree that:

  • You will not upload, submit, or provide any data (including PCB files, 3D CAD data, drawings, or other materials) or place orders for products that:
    1. Contain any weapons or weapons-related items. "Weapons" include but are not limited to: firearms, firearm components, ammunition, bladed weapons (e.g., automatic knives, stilettos, switchblades), explosive devices, toy guns or weapon replicas, and any accessories or parts that contribute to the functioning of a weapon (e.g., scopes, mounts).
    2. Include critical (functional) parts for aerospace, watercraft, offshore, automotive, or medical applications.
    3. Infringe, misappropriate, or violate any third-party intellectual property rights (including copyrights, patents, trademarks, trade secrets) or other legal rights.
    4. Contain false, misleading, harassing, discriminatory, defamatory, or otherwise objectionable content, or content used to produce counterfeit goods.
  • You will not interfere with the security or normal operation of the Site or Services, including but not limited to transmitting viruses, malware, or other destructive code; engaging in denial-of-service attacks; or bypassing security features.
  • You will comply with all applicable supply chain security standards, such as GSV, C-TPAT, and AEO, to ensure secure trade and prevent terrorist activities.

4.2 Conflict-Free Minerals

We prohibit the use of "Conflict Minerals" in the production of our products. "Conflict Minerals" means gold (Au), tantalum (Ta), tungsten (W), cobalt (Co), tin (Sn), and other metals sourced from mines in conflict areas of the Democratic Republic of Congo (DRC) or other regions where mining is controlled by non-governmental military groups or unlawful factions. We require our suppliers to comply with the Electronic Industry Citizenship Coalition (EICC) Code of Conduct, source materials from environmentally and socially responsible suppliers, and prioritize smelters listed in the EICC-GeSI Conflict-Free Smelter (CFS) program. By using our Services, you agree to support our commitment to conflict-free mineral sourcing.

4.3 Export Control Compliance

Due to cooperation terms with our key suppliers, we regret to inform you that products/services cannot currently be provided to the following countries/regions: (Cuba, Iran, Syria, Sudan, North Korea, Crimean Region of Russia, Armenia, Belarus, Kazakhstan, Kyrgyzstan, Russia, Venezuela). The restoration of supply will be announced separately. Please download the compliance document.

You represent and warrant that you will comply with all applicable export, import, and cross-border trade laws and regulations, including but not limited to the International Traffic in Arms Regulations (ITAR), U.S. Export Administration Regulations (EAR), and relevant laws of the European Union, United Nations, and your jurisdiction. Without limitation:

  • You will not use the Services or purchase products for export to any prohibited country or region, including but not limited to Cuba, Iran, Syria, Sudan, North Korea, the Crimean Region of Russia, Armenia, Belarus, Kazakhstan, Kyrgyzstan, Russia, and Venezuela.
  • You will not provide any "Export Controlled Data" (data controlled under ITAR or EAR beyond EAR99) to us.
  • You will not sell, transfer, or divert our products or related technology to any prohibited entity or person, or use them for any prohibited purpose (including military, nuclear, missile, chemical, or biological weapons applications).
  • If your delivery address is in the People's Republic of China, you must download, sign, and submit the "Product End-Use Declaration" to your sales representative for review and approval before placing an order.

We reserve the right to request additional information from you to verify compliance with export control regulations. If you fail to provide such information or violate these obligations, we may suspend or cancel your order, freeze or close your account, and report the matter to relevant authorities.

5. Intellectual Property Rights

5.1 Our Intellectual Property

All content on the Site, including text, graphics, logos, images, software, and the design and layout of the Site, is the exclusive property of 3PCB or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reproduce, publish, license, or sell any such content without our prior written permission.

5.2 Your Intellectual Property

You retain ownership of all intellectual property rights in the data, files, and materials you upload or provide to us (including PCB, 3D CAD data, and drawings) for the purpose of using our Services. We will only use such materials to fulfill your order and will not share or disclose them to third parties without your written permission, except as required by law or to comply with our obligations under these Terms.

By uploading or publishing any content (such as customer reviews, inquiries, or articles) on the Site, you grant us a non-exclusive, perpetual, irrevocable license to store, use, copy, edit, publish, display, distribute, promote, translate, and adapt such content for business and promotional purposes, including incorporating it into other works or sublicensing it to third parties.

5.3 Infringement Claims

If you believe that any content on the Site infringes your intellectual property rights, please contact us at service@3pcb.com with relevant details, and we will promptly investigate and take appropriate action in accordance with our policies.

6. Pricing and Payment

6.1 Pricing

We strive to provide accurate pricing information on the site, but we do not guarantee the accuracy or currency of such information. Prices are subject to change before we complete your order. The price specified in your order confirmation (after we review your submitted files) is the binding price. We reserve the right to adjust the price or cancel your order if your submitted documentation does not comply with the order details. If we cancel your order after you have paid, we will issue a refund to your original payment method.

6.2 Payment

We accept payments through various methods, including major credit and debit cards (such as Mastercard, Visa, and American Express) and wire transfers. When paying by credit card, your information will be processed through a secure third-party payment processor, and we do not store your credit card details on our servers. You are responsible for any fees associated with the payment, such as currency conversion fees.

7. Delivery and Risk of Loss

We will ship your order within a commercially reasonable time to the delivery address you provided. Delivery dates are estimates only, and we are not liable for delays in delivery. We will, however, take reasonable measures to ensure that your ordered products are shipped and delivered within the estimated delivery timeframe.You are responsible for providing an accurate and complete delivery address; any additional costs resulting from incorrect or incomplete address information will be your responsibility.

Title and risk of loss for the products pass to you upon shipment. We are not liable for any damage, loss, or delay of products during transportation, but we will assist you in contacting the shipping provider to seek remedies if needed. For international orders, you are responsible for paying all VAT, tariffs, duties, and other import-related fees required by your country.

8. Returns and Refunds

Our products are custom-designed based on your specifications, so we do not accept returns unless the product is defective due to our manufacturing error. If you receive a defective product, please contact us at service@3pcb.com within 7 days of delivery, provide photos of the defect, and we will review your claim. If we confirm the defect is our responsibility, we will issue a refund or provide reproduce.

9. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SITE AND SERVICES AT YOUR OWN RISK.

We are not responsible for any errors or omissions in the data or materials you provide, and we do not guarantee that the products will meet your specific requirements or be compatible with third-party equipment or software.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST SAVINGS, OR LOSS OF BUSINESS OPPORTUNITIES) ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE USE OF THE SITE OR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE RELEVANT PRODUCT OR SERVICE.

11. Indemnification

You agree to defend, indemnify, and hold harmless 3PCB, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with: (a) your use of the Site or Services; (b) your violation of these Terms or applicable laws; (c) your uploaded data or materials infringing any third-party rights; (d) your breach of export control regulations; or (e) any other act or omission by you that results in harm to us or a third party.

12. Confidentiality

Both parties shall keep all confidential information received from the other party strictly confidential, except for information that is publicly available or authorized for disclosure by the copyright owner. "Confidential Information" includes but is not limited to drawings, designs, processes, software, financial information, business relationships, and customer data. You may request to sign a Non-Disclosure Agreement (NDA) with us to protect your confidential information; please send your completed NDA to service@3pcb.com.

13. Third-Party Links and Services

The Site may contain links to third-party websites or services for your convenience. We do not control these third-party sites or services, and we are not responsible for their content, privacy policies, or practices. Your use of third-party sites or services is subject to their terms of service and privacy policies, and you access them at your own risk.

14. Governing Law and Dispute Resolution

These terms are governed by and construed in accordance with the laws of Hong Kong, excluding its conflict of law rules. Any dispute, claim, or controversy arising out of these terms or from the use of this website and services shall first be resolved through amicable negotiations. If such negotiations fail, the dispute shall be submitted to the Hong Kong International Arbitration Center (HKIAC) for arbitration in Hong Kong in accordance with its rules. The arbitration award shall be final and binding on both parties.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and 3PCB regarding the Site and Services, and supersede all prior or contemporaneous agreements, communications, and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

15.3 No Waiver

Our failure to enforce any provision of these Terms at any time shall not be construed as a waiver of such provision or any future enforcement thereof.

15.4 Assignment

You may not assign these Terms or your rights under them without our prior written permission. We may assign these Terms to any affiliate or successor in interest.
